Bail

Re Biba: Anticipated delay in COVID times for committal stream matters (expected 2y7m) in and of itself amounts to exceptional circumstances [31-32].

Re Che Ashton: The evidence put before the court in opposition to a bail application should not contain inappropriate or irrelevant evidence, including the details of totally unsubstantiated beliefs plainly designed to be prejudicial to the application (e.g., beliefs about future conduct without basis) [75-77]
